June 1, 2015 - BMWED detailed comments requesting the Internal Revenue Service to classify railroad maintenance of way workers as "construction industry workers" for purposes of the application of the "Cadillac Tax" in the Affordable Care Act (ACA). Under the act, construction workers are considered to be a "high-risk profession" that is entitled to relief in the application of the Cadillac Tax. That tax applies a 40% excise tax on benefits provided by a healthcare plan that exceed certain dollar limits. The classification of maintenance of way work as "high-risk" will help us in bargaining the next National Agreement.
